Six further construction companies will be told the outcome of their appeals against the OFT cover pricing fines next week.

The Competition Appeal Tribunal has confirmed that it will hand down judgments concerning appeals made by the following companies next Tuesday 22 March at 10.30am:

·        Apollo

·        Galliford Try

·        GF Tomlinson

·        G&J Seddon

·        Interclass

·        Sol Construction

The biggest single fine of this group was levied by the OFT on Galliford Try, which received a penalty of £8,333,329, while Apollo was served with a fine of £2,150,536; Sol Construction £1,835,702; G&J Seddon £1,516,646; GF Tomlinson £1,269,270 and Interclass £464,406.

None of these companies are contesting liability.

Lawyers close to the process have told Building that they expect the judgments to be broadly consistent with that of last Friday’s decision on another six construction companies, including Kier and John Sisk. That judgment found that the OFT had applied “excessive” fines and reduced the amount they must pay by up to 94 per cent.

The largest monetary reduction was achieved by Kier, which will now have to pay less than £2m compared with the original fine it had faced of £17.9m.
