Kier Regional Ltd, has been fined £7,000 at City of London Magistrates Court and ordered to pay court costs of £2,640, after pleading guilty to two counts of breaching the Health & Safety at Work Act 1974.
The prosecution by the Health and Safety Executive (HSE) follows an investigation after a 21-year-old man working on the site in Kensington, London fell down a ventilation shaft while working on the roof in August 2004.
Miguel Olivares stepped on an area covered by a black plastic sheet beneath which was a 20m shaft. The construction company failed to ensure the hole had suitable and sufficient guard rails to prevent anyone falling in.
The company’s second offence was the unkempt condition of the site.
