Proposals for making construction adjudication fairer, more effective and easier to understand have been announced by construction minister Nick Raynsford.
The new proposals include:
  • better guidance and training for adjudicators so that they understand the powers and duties given to them;
  • better guidance to firms on their rights and how to use the system effectively;
  • amendments to the scheme provided speed, cost and simplicity of adjudication are not adversely affected;
  • amendments to the Construction Act to outlaw the practice of putting into contracts requirements that a party that refers a dispute to adjudication should bear the other party's legal costs.
Nick Raynsford commented: "I am keen to keep adjudication quick, simple and cheap. I want to improve guidance to adjudicators and, where necessary, amend the scheme to ensure that the original intentions of the legislation are fulfilled." A further review is expected to take place in 2003.
