Although Plymouth council’s antisocial behaviour unit has its own senior antisocial behaviour lawyer, it is not always possible or practicable to rely on the service of a lawyer.
We are a small team of four caseworkers, a senior lawyer and a manager. One of the unit’s caseworkers took the complaint of antisocial behaviour very seriously and decided to act on it. He initiated injunction action by approaching the court directly, made an application, with a witness statement, paid the fee and stood in front of a judge explaining his role as representing the local authority. The judge accepted this and awarded a without notice injunction with power of arrest. Is this a first?
