The Construction Industry Board has called for an end to bespoke adjudication processes in its review of the Construction Act.
In its report on the adjudication provisions of the Housing Grants, Construction and Regeneration Act 1996, the CIB argues that bespoke practices "have provided fertile ground for the development of avoidance mechanisms." The CIB has submitted an eight-page report to construction minister Nick Raynsford. The DETR will consider its recommendations before giving a detailed formal response.
Commenting on the DETR's likely response, CIB chairman Chris Vickers said: "We are hopeful that the changes to the scheme will be implemented, but I recognise that Parliamentary time to amend the Act may be difficult to achieve." Vickers thought that the industry could undertake voluntary improvement of contract forms and adjudication.
