The Institution of Civil Engineers has updated its Condition Of Contracts document that provides contractual dispute resolution for the industry.
The revised family of contracts - drafted in order to meet the requirements of statutory adjudication - aims to help opposing parties settle their contractual differences before embarking on dispute resolution proceedings.
The contractual dispute resolution procedure for ICE Conditions of Contract (Clause 66) replaces the ‘Engineer’s Decision’ with a series of problem-solving measures.
The ICE recommends that the revised Clause 66 be incorporated into any of the ICE Conditions of Contract for new contracts commencing on or after 1 July 2004. The new Clause 66 is now available to download from www.ice.org.uk/law
