Balfour Beatty Infrastructure is to be sentenced for safety breaches at the City of London magistrates court on 30 September after an unsupervised temporary railway worker was killed in October 2000.

Michael Mungovan, 22, died on 9 October 2000 at Vauxhall Station, south London, after he was hit by a train while working on the line.

It was Mungovan’s third day working for McGinleys Recruitment Services, which provides staff to Balfour Beatty. McGinleys is also being prosecuted.

Balfour Beatty and McGinleys admitted that they failed to conduct their undertaking in such a way as to ensure persons not in their employment were not exposed to risks to their health and safety.

An inquest into the death returned a verdict of unlawful killing at Southwark coroner's court on 20 May 2002. Mungovan was working as part of a two-man team securing a section of line when the accident occurred.
