Property developer goes to court over proposal to build an access road to a housing development

Property developer Dukeminster has launched proceedings over the status of a piece of land it has proposed building a road on, that Tesco maintains it owns.

Dukeminster wants to build a road in Devon between Old Rydon Lane and the A379 to provide access to a one of its developments. It says the land has adopted “public highway status”, which means Devon council and the Highways Agency can allow it.

Tesco, which owns a large store and petrol station near by, says it owns the land and has the right to choose who can use it.

The parties are seeking a High Court decision on the case.
