Roofing and cladding company taken to court to enforce adjudication decision

Kent company Tek-Space is headed for a High Court showdown with RKC Industrial Roofing and Cladding in a dispute over work on the Rotherhithe Tunnel.

The two companies entered into an agreement for the supply of structural steelwork for two ventilation shafts on the Rotherhithe Tunnel, according to a High Court writ.

But a dispute arose between the two sides, and adjudicator Matthew Bastone was called in to decide the argument, the writ says. On February 8 this year he ruled that RKC Industrial Roofing should pay Pontin Consultants, Tek-Space’s agents, £127,473.82.

Despite this, RKC Industrial Roofing has failed to pay up, it is alleged.

Tek-Sace is now asking the High Court to step in and make the adjudicator’s award a court order, and to order payment of the money, as well as interest running at 13% a year.
