Writ says Roxan overpaid sub-contractor Finlay Breton for work on 55 new flats on south coast

Building contractor Roxan Construction is headed for a High Court showdown with sub-contractor Finlay Breton in a row over a site at Bournemouth.

Finlay Breton agreed to design and install concrete floors, balconies, and staircases to the 55 new flats at The Reef in Boscombe Spa Road, for a price of £290,980, according to a High Court writ.

Work started in May 2005, and Southampton-based Roxan made various interim payments, paying a total of £420,052.60, and work was finished in February 2006, the writ says.

But Roxan says the final value of Finlay Breton’s work was £305,646.95, and argues that it had been paid more than £114,405.65 too much.

Finlay Breton, of Wells, Somerset, has refused to repay the overpayment, and with VAT, the total in dispute is £134,426.63, the court will hear.

Now Roxan is claiming damages and repayment of the sum overpaid, as well as interest.

The writ was issued by Paris Smith and Randall of Southampton.
