Civils firm FM Conway fails in an appeal against employment tribunal ruling

Six Kosovan workers will receive almost £50,000 for unfair dismissal after an employment tribunal rejected an appeal from civils firm FM Conway.

The workers were originally awarded the damages in July 2009 for dismissal from an Islington Council job in September 2008.

But FM Conway appealed the decision to award the workers £46,210.24.

Construction union Ucatt – which brought the claim on the workers’ behalf – said it was delighted with the outcome of the two and a half year legal battle.

George Guy, acting general secretary of Ucatt, said: “Far too many construction companies believe that they can treat workers, especially vulnerable workers, with contempt.

“Companies must learn to treat workers fairly and decently.”

The workers were originally employed by Crowleys on the council job but were transferred to FM Conway in 2007.
